Panama enforces strict national controls on vaping, but not a full criminal ban, following major legal changes in 2024 2025. After the Supreme Court struck down the earlier total ban law (Law 315 of 2022) for procedural flaws, the Ministry of Health issued Resolution No. 146, which takes effect 13 August 2025 and imposes sweeping restrictions on electronic cigarettes, heated tobacco, and oral nicotine products. The rules ban all advertising and promotion, prohibit sales to minors, require mandatory signage, and forbid public vaping in nearly all enclosed public and private spaces including offices, restaurants, hotels, public transport, schools, hospitals, and sports venues.

Punishment

Retailers must keep products out of customer reach, and improper display can lead to confiscation and penalties. Although the earlier total ban on import and sale was overturned, Panama still prohibits use in non smoking areas, restricts online sales, and empowers customs to inspect, detain, and seize prohibited shipments.
